If the only place that Marlo was truly alive was on the street, where his name would ring out, upon us seeing that kids on the corner don't remember your name (not for even 1 day), then he died. He can no longer be the Marlo that he wants to be.
Sure he's got 10 million, but he doesn't have the discipline or brains to operate like Stringer did (hell Stringer didn't have it either with Clay bleeding him) so the money is no good to him. I think its logical to assume that Marlo is 99% certain to end up in a cell, maybe then his name will ring out.

Spot on, wasn't that the term McNulty used in Season 2 when he was a "customer" in the Russian prostitution ring the team was trying to bust? I think Spot on was the term he was supposed to use while wired to let the team know when to do the bust.

Marlo's name rang out not his face. Because he had successfully insulated himself from the day-to-day operations of his trade, it was his name and reputation that rang out more than his face. Then, again, walking the streets on your own, with no muscle, chances are he would have been tried even if he had introduced himself by name.

Well actually yeah McNulty died. McNulty was always driven by the case. He had to be working a case. The whole five seasons is really based on the fact that MCNulty needed to bring down Avon and Stringer. He didn't just want to he needed to to full some personal void. He needed to bring down Marlow and thus the whole fake seriel killer.
Once Phearlman told Jimmy and Lester they could stay on the force but could never work a real case again that killed them. McNulty had no need to stay if he can't work a case. remember when he was internally dying on harbor patrol. He found that body floting in the water and he had to prove for his own good it was a murder. He made that case. Just like he made the first Avon case and Marlows as well.
